Netanyahu Arrest Row Deepens as New York Mayor Says City Cannot Enforce ICC Warrant

A fresh diplomatic and legal controversy has emerged after New York City Mayor Zohran Mamdani declared that the city lacks the legal authority to arrest Israeli Prime Minister Benjamin Netanyahu under an arrest warrant issued by the International Criminal Court (ICC).
In a video statement released on Tuesday, Mamdani said his administration had carefully reviewed whether New York City could enforce the ICC warrant if Netanyahu visited the city. After examining the law, he concluded that the municipal government has no independent power to carry out such an arrest.
Instead, the mayor argued that responsibility lies with the United States federal government. He called on federal authorities to cooperate with the ICC and enforce the warrant should the Israeli leader travel to New York.
The issue has drawn global attention because Netanyahu is expected to attend the United Nations General Assembly in New York later this year. His possible visit has reignited international debate over the ICC’s authority, accountability for wartime actions, and the relationship between international justice and national sovereignty.
The ICC issued arrest warrants in 2024 after stating there were reasonable grounds to believe Netanyahu was responsible for alleged war crimes and crimes against humanity linked to Israel’s military campaign in Gaza following the October 7, 2023 Hamas attack. Israel has consistently rejected the allegations and questioned the court’s legitimacy.
Mamdani maintained that individuals facing serious international criminal allegations should be subject to legal proceedings regardless of their political position. He said accountability should apply equally to everyone charged by the ICC.
The debate intensified after U.S. President Donald Trump stated earlier this week that Netanyahu would not be arrested while attending the UN gathering, signaling Washington’s continued opposition to the court’s actions against the Israeli leader.
Netanyahu’s office dismissed Mamdani’s comments, describing the ICC as a politically motivated institution and rejecting its jurisdiction over Israel.
The disagreement highlights growing tensions between international legal institutions and governments that dispute the court’s authority. It also raises broader questions about how ICC warrants can be enforced when suspects travel to countries that are not obligated to execute the court’s decisions.
As preparations continue for the upcoming UN General Assembly, the issue is expected to remain a major topic of international diplomatic discussion, with legal experts closely watching whether Netanyahu’s visit will trigger further political and legal disputes.
